By using Brandtastic’s services, signing an invoice, or submitting payment, you agree to follow:

2. Updates to These Terms

We may update these Terms occasionally. If we make changes, we will post the newest version on our website with a revised date.

Your continued use of our services means you accept any updated terms.

3. Key Definitions

  • Brandtastic (Company / Contractor): The service provider delivering marketing and related services.
  • Customer (“you”): Any individual or business purchasing services from Brandtastic.
  • Services: The marketing or consulting work described in your invoice or subscription plan.
  • Invoice: A document outlining pricing, scope, and service period.

4. How a Service Agreement Starts

A service agreement becomes active when:

  1. Brandtastic issues an invoice or service plan, and
  2. The customer makes full payment (unless otherwise agreed in writing)

Electronic acceptance and signatures are legally binding.

5. Scope of Services

Brandtastic will provide services as described in your invoice or service agreement.

Customer Responsibilities

To ensure successful delivery, you agree to provide any required materials (logos, images, access, information, etc.) within 3 business days of request.

Third-Party Support

Brandtastic may use trusted contractors, freelancers, or platforms to complete services.

Onboarding Period

Services typically begin after a 5 business day onboarding period following payment.

6. Rights & Responsibilities

Brandtastic May:
  • Decline requests that violate U.S. laws or advertising regulations
  • Pause or cancel services if the customer fails to meet obligations
  • Extend delivery timelines if delays are caused by missing customer materials
Brandtastic Must:
  • Deliver services as outlined in the invoice
  • Keep customer information confidential
Customers May:
  • Expect professional and timely service
  • Cancel service with at least 10 days’ written notice

If cancellation occurs after work has begun, Brandtastic may retain payment for completed or reserved work.

Customers Must:
  • Pay invoices on time
  • Provide requested materials promptly
  • Avoid interference with Brandtastic systems or security
  • Keep confidential information private

7. Payments

Pricing

Service costs are based on:

  • Published pricing
  • Quoted agreements via email or written communication
Payment Terms

All services require 100% upfront payment unless otherwise stated.

Payments may be made via:

  • Credit/debit card
  • Bank transfer
  • Approved online payment providers

Customers are responsible for any processing or banking fees.

8. Intellectual Property (Ownership of Work)

Once full payment is made, the customer owns the final deliverables produced specifically for them, including marketing content, creative assets, or strategy documents.

Brandtastic guarantees that work provided will not knowingly infringe on third-party rights.

9. Service Disclaimer & Limitation of Liability

Services Provided “As-Is”

Brandtastic provides services on an “as available” basis and does not guarantee specific business outcomes such as sales, revenue, or traffic.

Limitation of Damages

To the maximum extent permitted under U.S. law, Brandtastic is not liable for indirect or consequential damages, including:

  • Lost profits
  • Business interruption
  • Advertising performance fluctuations

10. Customer Indemnification

You agree to defend and hold Brandtastic harmless if a third party makes a claim related to:

  • Customer-provided content
  • Intellectual property violations
  • Misuse of Brandtastic services

11. General Terms

Entire Agreement

These Terms, along with invoices and policies, represent the full agreement between Brandtastic and the customer.

Governing Law (United States)

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules.

Dispute Resolution

Any legal disputes must be brought in the courts located in Nevada.

Electronic Communications

Email and electronic signatures are considered legally valid.

Customer References

Brandtastic may list you as a customer and display your logo for portfolio or marketing purposes unless you request otherwise in writing.

Force Majeure

Brandtastic is not responsible for delays caused by events beyond reasonable control (natural disasters, outages, pandemics, war, etc.).

12. Refund Policy

We do not offer refunds. Please contact us if you are unhappy with the service.
